New drafted Circular providing the list of products subject to TA certification and/or SDoC based on risk levels

MoST has just published the draft Circular replacing Circular 29/2025/TT-BKHCN and Decision 2711/QD-BKHCN for public consultation. This new draft Circular provides mandatory product lists based on the risk levels and the expected effective date would be from July 01, 2026.

In general, the draft Circular just merges the 2 lists of mandatory products under MoST management (e.g the list of EMC and safety products and the list of RF and ICT products) and put them into one consistent management mechanism under Circular 14/2026/TT-BKHCN.

Regarding Information and Communication Technology products (products under the current Circular 29/2025/TT-BKHCN), there are some highlighted features as below:

  1. The certificates, which were issued before the valid date of the new circular, will keep valid until their expiry date.
  2. With the application documents submitted to Authority before July 01, 2026, the certificates will continously be granted based on the current Circular 29.
  3. Certification requirements:
  • Products under Annex I of Circular 29 (those currently subject to TA certification and SDoC) will be treated as high-risk products under this draft and type approval certification under Certification Scheme 3 and Scheme 7 as well as SDoC shall be applicable. TA Certificates must be issued by a designated Authority.
  • Products under Annex II of Circular 29 (those currently subject to SDoC requirement only) will be treated as medium-risk products under this draft and local importers can do either:

(1) Getting the local report, using it for their SDoC process.

(2) Getting the local report, then applying for a certificate issued by an accredited Authority and using this certificate for their SDoC process.

  1. The certification schemes: Scheme 3 and Scheme 7
  • Scheme 7: Batch approval. We need to test and get certificate for each shipment. The sample must be taken from the actual shipment.
  • Scheme 3: The certification will be made based on tests of respresentative samples collected from the factory and factory inspection. Particularly:

(1) If the factory does not have any factory quality management certificate, factory inspection will be required and samples will be collected in this process. Detailed information of the certification and suveillance requirements are regulated in Circular 14/2026/TT-BKHCN

(2) If the factory has a quality management certificate which meets the following conditions:

+ The factory must have the qualification management certificate such as ISO 9001:2015;

+ The manufacturing scope must include the products which are applying for MoST certificate;

+ Remaining validity of the certificate must be at least 6 months; and

+ The certificate must be issued by an entity which is in MRA/MLA, ILAC, IAF, APAC

In this case, factory inspection and suveillance requirements will be bypassed and the certification requirements will be similar to the Certification Scheme 1 which we are currently proceeding.
