The Vietnam Government has just issued the Decree 26/2026/ND-CP, a detailed guidance of Chemical Law.
Based on this Decree, The Ministry of Industry and Trade has just issued Circular 01/2026/TT-BCT which has the list of chemicals in the electronic products which need to be declared.
The Circular 01/2026/TT-BCT is valid from Jan 17th, 2026.
From the new regulations, hazardous chemicals in products and goods with no chemical technical standard will need to be declared by the importer.
- The importer needs to declare the information on the Government Website for Chemical; and
- The importer needs to publish information on their website or on the under manual/label about the ingredient, content and recommendations to limit the use of products and goods containing hazardous chemicals.
The current Government Website for Chemical is http://chemicaldata.gov.vn/
Currently, online declaration by local importers of hazardaous chemicals has been allowed in this website but we have not seen any clear guidance for online declaration by the local importers of electronic products containing hazardous chemicals. Therefore, it is well advised that local importers of electronic products should register their own account in this website in order to get further update from it.
At the moment, concentration should be made on the preparation of information on the ingredient, content of the hazardous chemicals contained in the electronic products and recommendations to limit the use on the product documents first.
Below is the list of chemicals which need to be declared for the electronic products:
- Cadimium (Cd): 0,01% weight
- Chromium (VI) compounds: 0,1% weight
- Lead: 0.1% weight
